These Terms of Services (“Terms”) govern your access to and use of the FortunIQ Fuels website and services. By accessing our website, requesting a quote, or entering into an agreement with FortunIQ Fuels (“we,” “our,” or “us”), you agree to be bound by these Terms.
1. Our Services
FortunIQ Fuels supplies and delivers petroleum products, including diesel, petrol, illuminating paraffin, and related logistics services, to businesses and industrial clients across South Africa. Product availability, volumes, and delivery timelines are subject to confirmation at the time of order and may vary based on supply, location, and regulatory conditions.
2. Quotes and Orders
Quotes provided via our website or by our team are estimates based on prevailing market rates at the time of the request and are not binding until confirmed in writing. Fuel prices are subject to change in line with the Department of Mineral and Petroleum Resources’ monthly price adjustments and other market factors. Orders are only confirmed once accepted by FortunIQ Fuels and, where applicable, a signed agreement or purchase order is in place.
3. Delivery
We aim to deliver all confirmed orders within the agreed timeframe. Every delivery is accompanied by a Bill of Lading and security seals to confirm volume and product quality. Risk in the product passes to the client upon delivery and discharge at the agreed site. Delays caused by circumstances outside our reasonable control (including weather, road conditions, supply disruptions, or regulatory action) will not constitute a breach of these Terms.
4. Payment
Payment terms will be agreed in writing prior to or at the time of order confirmation. Late or non-payment may result in suspension of future deliveries and/or the application of interest, in accordance with our standard credit terms.
5. Website Use
You agree to use our website only for lawful purposes and not to misuse, disrupt, or attempt to gain unauthorised access to our systems. Content on this website, including our logo, branding, and text, is the property of FortunIQ Fuels and may not be reproduced without our written consent.
6. Limitation of Liability
To the extent permitted by law, FortunIQ Fuels shall not be liable for any indirect, incidental, or consequential loss arising from the use of our website or services, except where such liability cannot be excluded under South African law. Nothing in these Terms limits liability for gross negligence, fraud, or death or personal injury caused by our negligence.
7. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The updated version will be posted on this page with a revised effective date.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa, and any disputes will be subject to the jurisdiction of the South African courts.
